Texas passed a bill instructing for the creation of an optional Designation of Representative for Notice form, which was recently released by the Texas Comptroller. This statute provides an account owner or a renter of a safe deposit box with the ability to designate a representative to receive an Unclaimed Property notice. This Unclaimed Property notice is required by Texas statute in the event that the holder’s property is presumed abandoned. The designated representative has the limited authority relative to this notification regarding unclaimed property. However, the representative does not have any rights or is otherwise given authorized access to the account or safe deposit box. These changes become effective September 1, 2017.
