On May 31, 2017, the Federal Reserve Board (Board) announced it has proposed final amendments to certain sections of Regulation CC. These proposed amendments focus on electronic check collection and return and include new warranties regardless of the check form. The proposed amendments are meant to modernize the regulation for check collection from a mostly paper-based focus to an almost exclusive electronic focus. The Board is also requesting public comment on a separate amendment in the liability section as to disputes on whether the electronic check has been altered or forged when the original paper copy is not available. Public comments must be submitted by August 1, 2017. The proposed amendments will become effective on July 1, 2018.
