A plethora of lawsuits have been filed against Fannie Mae, Freddie Mac, and the FHA alleging damages for unpaid excise taxes (transfer taxes). The onslaught of litigation is an expected result following a ruling handed down by a federal district court judge for the Eastern District of Michigan which held that the GSAs were not exempt from transfer tax liability. Several recording offices have refused to record various GSA deeds without first receiving payment for transfer taxes. Fannie, Freddie and the FHA have filed a lawsuit seeking declaratory relief in federal court in Illinois.
